Agreement to Terms

By accessing or using Habitten, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the service.

1. Eligibility and Age Requirement

  • You must be at least 18 years old to use Habitten.
  • By creating an account or using the app, you confirm that you meet this minimum-age requirement.
  • Habitten is not directed to children under 18 years of age, and we do not knowingly collect personal data from minors.
  • If you are under 18, you may not create an account or use any features of the app.

2. Purpose and Nature of the Service

  • Habitten provides AI-generated suggestions, reminders, and insights intended solely for motivational and educational purposes.
  • The AI habit coach is not a licensed therapist, counselor, or medical professional, and the content it produces should not be interpreted as medical, psychological, or therapeutic advice.
  • Always consult qualified professionals regarding your health, safety, or well-being.

3. AI-Generated Content

  • You understand that AI outputs are generated dynamically and may occasionally be inaccurate or inappropriate.
  • By using Habitten, you accept responsibility for your own interpretation and application of AI-generated information.
  • We disclaim liability for any reliance placed on AI responses.

4. Disclaimer of Liability

  • To the fullest extent permitted by law, Habitten and its affiliates disclaim all warranties, express or implied, regarding AI-generated content.
  • Habitten is provided "as is," without guarantees of accuracy, reliability, or fitness for any purpose.

Description of Service

Habitten is an AI-powered habit tracking and accountability application. The service includes habit tracking, journaling, AI coaching, progress analytics, and related features.

Subscription and Payment

Pricing

Habitten is offered as a subscription service for $4.99 per month. All fees are in U.S. dollars and are non-refundable except as required by law.

Billing

Subscriptions are billed through the Apple App Store. Your subscription will automatically renew unless you cancel at least 24 hours before the end of the current period.

Cancellation

You may cancel your subscription at any time through your App Store account settings. Cancellation takes effect at the end of the current billing period.

Refunds and Consumption Data

When you request a refund for an in-app purchase through Apple, you consent to Habitten sharing relevant consumption data with Apple to help them evaluate your request. This data may include your account tenure, the extent to which you have used the purchased content, your lifetime purchase and refund history across platforms, and similar usage information. We share this data through our payments provider (RevenueCat) solely to respond to Apple's refund requests in accordance with Apple's policies.

User Account

  • You must be at least 18 years old to use Habitten
  • You are responsible for maintaining the security of your account
  • You are responsible for all activities that occur under your account
  • You must provide accurate and complete information
  • You may not share your account with others

Acceptable Use

You agree not to:

  • Use the service for any illegal purpose
  • Violate any laws or regulations
  • Harass, abuse, or harm others
  • Attempt to gain unauthorized access to the service
  • Interfere with or disrupt the service
  • Upload malicious code or malware
  • Reverse engineer or attempt to extract source code
  • Use automated systems to access the service

Intellectual Property

The Habitten app, including its original content, features, and functionality, is owned by Habitten and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain all rights to the content you create (habits, journal entries, etc.), but grant us a license to use this content to provide the service.

AI Coach Disclaimer

The AI coaching feature is provided for motivational and accountability purposes only. It is not a substitute for professional mental health services, medical advice, or therapy.

Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

  • The service will be uninterrupted or error-free
  • Defects will be corrected
  • The service is free of viruses or harmful components
  • Results from using the service will meet your expectations

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HABITTEN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

Account Termination

We reserve the right to terminate or suspend your account and access to the service at our sole discretion, without notice, for conduct that we believe:

  • Violates these Terms of Service
  • Is harmful to other users, us, or third parties
  • Violates applicable laws or regulations

5. Changes to Terms

We may update these Terms periodically. Continued use of the app constitutes acceptance of the revised Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
